im married with us citizen from 9 months. im leaving a emotional abuse,ask him to stop this controling behavior ,he told me he will follow for a divorce. never send my paper in for green card, i have a six years old child also. can he put us in the streets? do i have any rights here? we will be deported? thanks for answer me.

If you are illegal, yes, you can be deported.

If you are married to a US citizen who abused you in this relationship you have right to self-petition for a green card under a federal VAWA law. You will need to prove abuse, domestic violence, your good moral character, residence with abuser, etc.

If approved, both you and your child (of not a US citizen) can get Green Cards (permanent residency) without any assistance of your husband.
