Legal Question in Immigration Law in New Jersey

Town Ordinance and Pending I485

I was caught shoplifting back in 2000 and with the help of criminal lawyer the case was downgraded to court ordinance - we had to pay ony fines .

I have some doubts and concerns on how my past mistake can jeopardize my permanent residence in US.

I really appreciate if you can clarify my doubts.

Currently i am on H1B status and I applied for Adjustment of status in July 2007 on Employment based category, I got my EAD for one year and about to receive my Advance parole.

but on the I - 485 forms i did not mention about my case, because i thought its town ordinance not a crime, same thing i did for my husband.

What can be consequences for this ?

Can USCIS send RFE regarding this and call for interview?

Do i have to disclose to immigration lawyer ( he is through my employer - I really don't want to because my employer will come to know my bad past)

I am planning to go India in March after 10 years on advance parole - Do you think when i reenter Port officer can question us?

Re: Town Ordinance and Pending I485

In reviewing the final disposition of your criminal case, one would have to determine if you were convicted of a crime of moral turpitude, which can lead to one's inadmissiblity.

Also, depending on how you answered the relevant questions on the I-485 application, you may have misrepresented if you did not disclose that you were arrested.

It is advisable you consult with an immigration attorney before making any travel arrangements in order to fully assess your situation.
