partnership broke after 20 yrs leaving partner gave 2 wks notice then left and formed llc with same name used by partnership .Partnership not trade mark or registered

Your use of the name for twenty years in the U.S. gives you and the corporation trademark rights, assuming you used the name to sell goods or services. You can definitely stop any confusion. The question is what you want exactly?
