noise neighbors

My neighbors upstairs make noise 24 hours a day I have complained to management about this all time. management said they are working on this since september and nothing has been done about this. Can i hold back from paying rent because I cant sleep i havent had a peacefull day in my apartment the tenants who lived there before me moved out because of the noise. Also can I sue the owner for back rent due to the condition that i have to live with. The people called dyfs on me and told them i was beating my child, Dyfs came in and spoke to us and closed the case for it being untrue. Ive called the police about the noise they said they couldnt do anything about it management has to take care of it . What can I do abou this problem

I understand, and you are describing the neighbors from Hell, which is far too common.

I can not give you lawyer advice. I can only give you practical advice.

You are probably fairly comfortable with your apartment, and you can afford the rent. Still, it seems you should find another place and move out.

I have no idea if you would succeed in suing the landlord or the nasty neighbor. You might want to sue the landlord (wait until AFTER you leave!!) for failing to provide a liveable apartment, and you could possibly sue the nasty neighbor for the wrong they have done to you. I suggest you consult an attorney before you sue anyone.
