Legal Question in Medical Malpractice in New Jersey

Medical Malpractice

22yrs old. Had C section on 6/14 - on 7/2 went to ER with severe headaches, BP 146/102, vomiting. Was admitted to hospital to have test done (ie MRI, CAT). Was released on 7/3 by dr saying test came back negative and that his diagnosis was migrane. Headaches was called by neurologist 7/4 saying that I should have not been released because test were inconclusive. I needed to have test redone. Next day back at er with with same symptoms. Sent home with migrane diagnosis. In the ER 1 more time and sent home before neurology appt. Neurolgist took BP which was 166/102. Had me admitted to hospital. Had me transferred to Jefferson (because he did not feel comfortable with care). New hospital finds blood clot in brain. Was told that if i waiting another week i could have been dead. My question is, could the dr that released me the first time from the hospital be liable because this could have been caught then if he would have made sure the test were complete.
