You need to speak to another attorney, who can help you find out whether a suit was ever filed, and if so what the status is. You can get that information at the local and federal courthouses yourself but it won't help you much with the old attorney.

There is no telling what happened here. Is this an attorney who regularly handles malpractice? Malpractice litigation is neither for the faint of heart of part timers.
