Prescribed Wrong Medication

Hello, I filled a prescription at a local Walgreens Pharmacy on Monday, March 12, 2007. The prescription called for 12 Tylenol #3. On Wednesday I looked in the bottle for whatever reason and I saw that mixed in were at least three Tylenol #4. I called the pharmacy and was apologized to. My question, i guess, is there any legal ramifications that can happen for their negligence? Thank you.

As the other attorneys said, only if you actually took them and got sick. Otherwise, no.

If you took the wrong medication and became sick or were otherwise injured, then you may have a case. Every personal injury lawsuit requires negligence and some type of tangible damage caused by that negligence.

I cannot speak to whether there are �any� legal ramifications to this kind of error, only whether I personally would take this as a medical malpractice case. I would not take this case because, according to what you have said, you�ve not suffered any harm from this error.
