Legal Question in Medical Malpractice in New Jersey
Prescribed Wrong Medication
Hello, I filled a prescription at a local Walgreens Pharmacy on Monday, March 12, 2007. The prescription called for 12 Tylenol #3. On Wednesday I looked in the bottle for whatever reason and I saw that mixed in were at least three Tylenol #4. I called the pharmacy and was apologized to. My question, i guess, is there any legal ramifications that can happen for their negligence? Thank you.

As the other attorneys said, only if you actually took them and got sick. Otherwise, no.
Re: Prescribed Wrong Medication
did you take any of the wrong medication? If so , your case may have some negligible value.
Re: Prescribed Wrong Medication
If you took the wrong medication and became sick or were otherwise injured, then you may have a case. Every personal injury lawsuit requires negligence and some type of tangible damage caused by that negligence.
Re: Prescribed Wrong Medication
I cannot speak to whether there are any legal ramifications to this kind of error, only whether I personally would take this as a medical malpractice case. I would not take this case because, according to what you have said, youve not suffered any harm from this error.
Personal injury lawyers, in general, will provide free phone screening of your case, so if you are interested in pursuing a possible recovery, I encourage you to go to the Yellow Pages and beginning calling personal-injury attorneys to see if anyone is interested in handling this case.
