Legal Question in Personal Injury in New Jersey

car accident with a business vehicle I own

I own a commercial vehicle. My driver hit another driver 2 years ago and my insurance company sent me a claim settlement advisory that states that stated that they would be making payments to the person involved in the accident. Here it is 2 years later and I received a notice from the Superior Court of NJ that says that this same person has filed a lawsuit against me and my company in the Superior Court of NJ. Can they sue me after my insurance company has already paid them?

You need to obtain further information from your insurance company as to the terms of their "settlement" with the other driver. Typically a Release needs to be signed by the other driver, in which he would agree to accept the terms of the settlement and not pursue any further claims. So you need to find out if such a Release was obtained in this case and, if so, the terms of that Release. In any event, your insurance company should provide you with defense and indemnification, which means that they will provide you with an attorney to defend you and will pay up to the limits of your policy should this case settle or should a judgment be rendered against you and/or your company. My firm defends cases such as this, so if you have any further questions or need further assistance, please feel free to contact me.
