Legal Question in Personal Injury in New Jersey

financial recovery from injuries

i have severe injuries from an auto accident. the other party involved was totally at fault. the other party has the minimum liability insurance required by law, and i have underinsured motorist coverage in my auto insurance policy, which will not exceed the amount paid by the other drivers policy. if my anticipated damage claim exceeds this combined amount, how can i collect, and what tactics would the other driver and his insurance company use to avoid paying damages?

Re: financial recovery from injuries

Generally, when a damages claim or award exceeds the policy limits, the plaintiff may pursue the defendant's individual assets. Unfortunately, it is often the case that the defendant has no other assets, but there are occasions where it is a viable scenario. As this is quite a complicated area of law, please feel free to contact my office at 732-246-0909 to discuss further.
