Legal Question in Personal Injury in New Jersey

Personal injury payout

Why does it take so long for personal injury lawyers to pay their clients once the case has been settled and the check issued from the insurance company that was sued in an automobile personal injury case?

Re: Personal injury payout

It should not take more than a week or two, unless the case involved a minor or death, such that court approval was needed. Also something we see more of these days, if medicare or medicaid are getting reimbursed for expenses, sometimes we ask them to compromise and they can take months to decide. But if there isn't a good reason that the attorney has explained, I'd be very concerned about a delay in distribution beyond two weeks from when the insurance company's check came in.

A lot of time it takes the insurance company a month or so to issue the settlement draft. There also may be issues with liens on your file from various health care providers and thus final bills must be received in order to have the correct payoff figures. I would say six weeks after settlement you should have your check.
