Legal Question in Traffic Law in New Jersey
Careless driving 39:4-97
Hi- I was backing out of the residential driveway of my apartment complex. It is a very hard place to make turns as it is difficult to see oncoming traffic. Anyway, I pulled out and hit a car. Their car was barely damaged but mine was. The catch - the driver was a cop. The police came immediately (small town) and immediately got my info. I never got the driver's info (and he was downright rude to me, didn't even ask if I was OK - then drove off!). Anyway, here I am thinking that insurance will deal with all this. A few days later, I get a summons in the mail for this careless driving violation (I have a totally clean record, no tickets ever). Is this legit? I've never been to court so no idea what I am supposed to when I show up. Please help - and do I really need a lawyer. It honestly seems like the police just want money!

The fact that you had a collision with another car is sufficient for the issuance of a Careless Driving ticket against you. The ticket does not have to be issued on the spot, it can be mailed to you. Whether or not to hire a lawyer is up to you. You always have the right to represent yourself in court.
