Legal Question in Traffic Law in New Jersey

cdl required?

if an employer of a construction company has one of their employes drive one of their trucks that requires a cdl, and that employee does not hold a cdl,but that employee has an accident striking a person while he is on work time with that truck who is liable? and what can be done about the person who was driving the comp.truck with no cdl? thank you

There are alot of issues here that may need clarification. However, it appears that both the driver and the company may be liable for the injuries and/or damages caused. The CDL issue may not make any difference to the person who was harmed. It may, however, be an issue between the company and their insurance company. Keep in mind that this advice is based purely on the little bit of information that you have given to me. There may be other factors that would change my opinion.
