Legal Question in Traffic Law in New Jersey

Hello. My daughter was driving her friends car and got into an accident. She hit a small median and damaged the car - noone was injured and no property damaged occured. She was 17 at the time. No police report was filed since this happened during school hours and the school policeman did not make a report. The owner of the car which is the father of my daughters friend now wants us to pay for half the damages, which is fine but he won't provide an estimate of the damages. This accident happened in late October 2008 and he still as of today has not provided an estimate to us but wants us to pay for the damages to the vehicle. The reason he hasn't got the car fixed through his insurance is because he doesn't have Collison coverage on his policy. I'm not sure what my legal rights are since this accident happened almost a year ago and this guy still hasn't provided an estimate to us. He keeps pressuring my daughter to pay half so I'm not sure what to do? Please help. Thanks.

He wants you to pay half, but he won't tell you the dollart amount of the damage? How are you going to know what half is? I would just ignore the guy until he gives you a dollar estimate. If he tried to sue you he would first have to get an estimate and then try to go through his insurance company. His insurance company would then come up with an estimate of their own and determine how much, if anything, they would pay. If he isn't willing to go through any of these correct procedures, then you really can't be held liable for the damages. He can't just demand money from you. If he keeps harassing you then you can file a harassment complaint against him at your local police department.

Sincerely yours, -Ronald Aronds, Esq.-
