Legal Question in Traffic Law in New Jersey
I was the driver of a vehicle and my wife was sitting along side me as a passenger. I was stopped by a police officer and ticketed for going through a red light. My position was that I did not do anything wrong. My wife also insists that I did not go through a red light. Can I use her as a witness when I make my court appearance, or is it a waste of time?

If you feel that you didn't break the law then you have the right to a trial where you would try to convince the judge you did not break the law. If your wife was an eyewitness to the event then you can call her to testify on your behalf. Don't plead guilty to anything if you don't feel that you are guilty.

Although I cannot guarantee the ultimate outcome, as indicated by the other attorneys, you definately have the right to proceed to trial. The police must submit proof at trial that you went through the red light. You have the right to testify and have your wife testify that you did not. It will be up to the judge to decide. You can certainly call your wife as a witness in your defense since she was in the car at the time of the incident, I cannot guarantee the outcome, but many judges are very understanding and the prosecutor might even consider dismissing or withdrawing the ticket.
