Legal Question in Traffic Law in New Jersey

Hold up

I was pulled over by a cop for making a right turn on red which there is a sign there saying you can do this after 4pm. The cop came to my car and asked for my paperwork. I unfastened my seat belt and reached over to my glove compartment and got my paperwork. As he was writing the ticket I asked if he could hurry because I had to get my child from daycare by 6:00 it was 5:45. he said no..I didn't say a word then but it was taking him a long time to write 1 ticket so I asked what the problem was. He said he was writing me another ticket because I didn't have my seat belt on. Mind you my car was pulled over and turned off. How can I beat handle these tickets?

Re: Hold up

You should report the officer to the internal affairs office of his police department.

Re: Hold up

There should be a defense to the ticket if what you say is true. The ticket should have the time written on it and then you should take a photograph of the sign which allows right on red after 4:00PM. The seatbelt will be your word against his. Re: Hold up

Unfortunately I have heard a lot of complaints similar to yours about different police officers. You can report him to the station where you got the ticket so they can investigate his behavior, but I don't know how far that would go. Regarding the tickets themselves, this is a matter where you should hire a lawyer to either get the tickets dismissed on the facts of the case, or to take it to trial and try to convince the judge to find you not guilty of the two charges. I am an attorney who has handled many cases similar to yours in the past in various courts in New Jersey. I would be very happy to discuss this matter with you in person or over the phone. You can reach me at 908-272-0111. There is never any charge for my simply discussing a case with you.
