Legal Question in Traffic Law in New Jersey
Leave the Scene of an Accident
My son who is 17 had an accident yesterday. It involved him passing thru an intersection without looking carefully. He was hit by another car. After he stopped and got out. He got panic and drove off. After talking to his mom, he went to the Police and reported that incident. He was given 3 tickets: Leaving the scene of an accident, Careless driving and Making a left turn on a one way street. Do you need to hire an attorney? His driving record was OK (no tickets) up to that accident.

If an injury was caused by the accident, your son faces a jail sentence. Otherwise, your son faces the loss of his driving privileges for six months. He definitely should have an attorney. Try to get someone who is familiar with the Court he will be in. If it is Morris County, call our office. As a former municipal court judge, I am sure our firm can help him. The legal fee would be about $1,500. However, that depends on all the circumsances after reviewing the case and interviewing your son. Again, if we can be of assistance, please call. Good luck.

Sorry to hear about your son's accident - I hope he is ok. The decision about whether or not to hire an attorney is always a personal one. You need to consider many factors and do a careful cost/benefit analysis.
The offenses your son was charged with are very serious offenses that could include high fines and, most importantly, license suspension and surcharges. You should consider these potential outcomes when deciding whether or not to hire an attorney.
I offer free consultations and would be happy to speak with you and/or your son. If the Court is located in Mercer County or South, I may also be available to represent your son if you decide to hire an attorney. In the meantime, feel free to check my website at njlawpages.com for more information about myself and my practice areas.

Re: Leave the Scene of an Accident
I strongly suggest that you hire an attorney. Do not, under any circumstances, plead guilty to these summonses. Leaving the scene carries serious consequences, including loss of driving privileges. Your son has also been charged with two separate point carrying violations, and as a probationary driver,(due to his age) faces suspension if he were to be convicted of both of those violations. An attorney experienced in municipal court matters can probably negotiate a resolution that would save your son's license. It is important to have an experienced advocate represent your son's interests, as the State is represented by a prosecutor, who is an attorney.
I am very experienced in this area of the law, and would welcome the opportuity to talk to you further.
