Legal Question in Traffic Law in New Jersey
Hi, I live in NJ and my car was impounded today for not being insured. I want to have it towed from the lot without insurance and set it on a friends property. Is there a law saying they can not release it even if it is not being driven?

technically, if the car is uninsured, it is not even supposed to be parked on the street. If it was impounded, they will probably not release it to you unless you can provide proof that you have corrected this issue and obtained or reinstated coverage for the car. This is based on the fact that every vehicle that is garaged in this state must have insurance as required by stature. Does the car run? were you driving it at the time prior to it being impounded? If the vehcile does not have a working engine, it might be a different issue, but you will probably need to show them proof of coverage before they agree to release it. feel free to contact me should you have any questions. Yes. Police are not permitted to release the car - even for towing, without valid insurance. It used to be that police were permitted to let you have it towed to private property for storage. The law changed a few years ago and they are no longer allowed to do that. If you have any questions, feel free to call me at 877\688\3879.
