Legal Question in Traffic Law in New Jersey
Nj, Could be facing jail next time with an offense?? Need to clarify
My history,
7-2-04 - 3 points for improper turn traffic control sign.
03-05-05 - Unsafe operation of Motor vehicle( the cop said I did'nt stop at the STOP sign, which was not correct, I had stopped at the STOp sign but what since it was a 4 lane I did'nt take enough time before making the left) - pleaded guilty paid more fine and avoided points(initially I thought it was 2 points but that was 4 i think)
07-02-05 - 3 Point credit - annual safe driving
07-13-05 speeding 45in 25 zone got 4 points - got it reduced to 0.
I pleaded guilty and got a deal frm the public prosecutor on the last violation. The judge said I would face jail time next time. Can someone enlighten me on the law?
I did'nt ask the judge clearly why I would be facing jail time if next time I get a traffic ticket( my mistake, i regret for not using a lawyer or asking the judge why I would face jail time). Is it ok to ask the judge to clarify something when they give a judgement? Can they use my query against me? How long will this stay on my record? SHould I consult a lawyer? How long should I be carefull of not accumulating points anymore? ( I know the answer is never but just to be very cautious)

You should always be very cautious with driving, without exception. Remember, the reason that you should be cautious is not just to avoid tickets; it's to avoid accidents and perhaps (fatal) harm to you and to others. And in answer to your question, you should get your driver abstract from the Motor Vehicle Commission and then make an appointment with a lawyer to discuss it with him/her. Good luck!

Sorry for the late reply, but I have been out of state for the week and just returned today. For a moving violation, a traffic ticket with points, you don't go to jail. The judge was trying to scare you, I think. Since I don't know the full details, I guess that is what he was doing simply based on the information you have provided. If you would like to discuss your case in more detail please call me at 908-272-0111. Thank you.
