Legal Question in Traffic Law in New Jersey
Non contact Accident
Someone swerved into our (center lane (from the fast lane) without any indication and came broadsided to our vehicle. We swerved to avoid collision, our car lost control and we hit the median dividing the interstate. This person sped off subsequently and is not traceble. The traffic police took down the facts and asked us to contact them for the ticket. We dont know the details of the ticket.
1. Who is at fault here.
2. What happens in these types of accidents with regards to tickets.

Without more information, including the make, model, and tag number of the other vehicle you could not have a ticket issued to the unknown driver. Any property damage to your car will have to go through your insurance company. Was anyone injured?? If so you may have a claim for personal injuries - pain and suffering and for other damages against your own auto insurance company under your own uninsured coverage portion of your policy, sometimes referred to as a �phantom vehicle claim�. Medical bills will normally be paid through your auto insurance company as well. You must timely put your insurance company on notice of the claim and usually must file a formal claim (in NJ) within 2 years of date of accident.

Unless you have some information on the hit and run vehicle, you are not going to be able to issue a ticket. If you can find a license plate, you could issue a ticket for Careless Driving, another for Leaving the Scene of an Accident and yet another for Failure to Report an Accident. The ticket would be issued in the municipality where the infraction occurred.
