Legal Question in Traffic Law in New Jersey

Ramp in street damaged 2 tires

I live in a private lake community where the speed limit is 25 mph on my street, which many people do not adhere to. Alot of kids play in the street all the time and locals are aware of this and yield to them. My son & his friend had put a skateboarding ramp at the very end of our driveway and were riding a bike off of it. A large pickup truck came down the road and slammed into the ramp, barely missing my son's friend. I was watching from my deck and it made such a sound I thought for sure someone had been hit. The truck stopped up the street when he realized he had a flat tire. He came down yelling at me and the kids, irate that this had occurred. Neighbors were appalled by his behavior - and now he is suing me for 2 new tires and time lost from work. Where do I stand on this, legally? What should I bring with me to court to help me win this case?

Re: Ramp in street damaged 2 tires

My advice is for you to contact your homeowners insurance company and let them and their attorneys handle to defense of this case for you. If you are sued you have to file an answer to the complaint in a timely manner, and if this isn't done then a default and judgement can be entered against you. There are specific legal procedures that need to be followed, so if you are sued you definitely need a lawyer to represent you and your insurance company should provide one. Just to let you know, in my opinion if the ramp jutted out into the street at all there is a high probability that you will be found liable for the damages to the truck. Anyway, I repeat myself - contact your homeowners insurance company today about this.
