Legal Question in Traffic Law in New Jersey
Hello. I received a ticket today for driving in an hov lane and i feel as though i was wronged big time. The officer was in an unmarked car and as i was driving on the turnpike i saw a car that drifted onto the shoulder then back into the 2nd lane over. curious to see if the person was alright i decided to go next to them in the hov lane. at that time the car went behind me and pulled me over. after i received the summons i had told the officer i believed it was ridiculous for me to receive a ticket due to the fact i was interested in the safety of another driver. He then began to yell and tell me that i could fight the ticket in court but i would lose because the video would not show his driving just him pulling me over. He essentially admitted to reckless driving, and improper use of an emergency lane. I feel as though i was blackmailed or incriminated by the officer because he knew he would get away with it and he just yelled at me raising his voice in frustration. What should i do?

Go to court with a lawyer and let him talk to the officer and try to arrange a compromise that will result in no points.....or if there is no compromise available, then tell your story in a forthright polite manner......

What was the specific statute (was it writewn on the ticket) that the officer claims that you violated. You can either represent yourself or retain a lawyer to represent you in Court. Regardless of what you choose, you should speak to the municipal prosecutor and explain to him what you believe happened. You need to find out if the prosecutor will agree to do something to assist you or amend the ticket to something that maybe carries a lower fine. If you feel that you did not do anything wrong, then you can go to trial and explain you side of the case to the Judge. You must always be respectful to the Court as well as the prosecutor.
