Speeding and Reckless Driving Tickets
I was radared by a state trooper doing 92mph in a 65mph zone. He also issued a summons for reckless driving and stated it was a mandatory summons since I was caught going over 90mph. I wasn't speeding out of malice and didn't realize I was going that fast at the time. I immediately slowed down between 70-75mph and was in the right lane as he put his lights on. I have one point on my license from two previous speeding violations from tickets over a year ago. Using a lawyer, what are the chances of having the tickets reduced so my insurance doesn't skyrocket?

It is clear that you need to retain an attorney regarding your traffic matter. Typically, reckless driving carries 5 points and I assume that you also recieved a ticket for speeding 27 miles over the speed limit which carries 4 points. An attorney will likely be able to negotiate an adequate plea so you will not recieve 9 points. You may contact me to discuss your matter further.

The answer to your question is that an attorney will be helpful in trying to reduce the penalties on the tickets including points. In general, the State has to prove you committed this offense, usually by the �beyond a reasonable doubt: standard. If they fail to prove the charge you cannot be found guilty. If you plead guilty or are found guilty you are subject to points, fines and penalties. Seeking an advice of an attorney is always advisable. Please feel free to contact me.

Depending upon the court, prosecutor, and the state trooper who issued the summonses, I believe that I can knock down the points you are looking at significantly. Going on your own, I believe your chances for lowering the points are less. Currently these two tickets add up to 9 points (4 points speeding, 5 points reckless driving). In my most recent experience (last week) similar to yours I was able to knock down the 9 points for a client of mine to two points. This is about average for the cases I have handled. But remember, I can never make any definite promises about the outcome of a case - I can only tell you what my previous experiences have been. Well, the chances are very good that if you DON'T get a lawyer to assist you, you will have a very adverse outcome. If you get a lawyer, you may be able to generate a workable legal or factual defense, which may enable the lawyer to plea-bargain on your behalf.
