Legal Question in Traffic Law in New Jersey

I would like to know what possible defense can be made, for running a stop sign.

Also our local judge does not dissms cases solely because the officer did not show, how can I convince him to do so.

The answer to your question is that unless you demanded a �Speedy Trial� the judge will allow a few court appearances for the officer to show up. An attorney will be helpful in trying to reduce the penalties on the tickets including points. In general, the State has to prove you committed this offense, usually by the �beyond a reasonable doubt: standard. If they fail to prove the charge you cannot be found guilty. If you plead guilty or are found guilty you are subject to points, fines and penalties. Seeking an advice of an attorney is always advisable. Please feel free to contact me.

The only defense to running a stop sign ticket is to convice the judge that you really did not run a stop sign. If the office rdoesn't show up you can ask the judge to list the case as "Try or Dismiss" at its next listing. Another alternative would be to plea bargain down the 2 point stop sign ticket you currently have to a zero point ticket for unsafe driving. The defenses are that you stopped behind the stop line if there is one and then got to the corner where you did not stop again because you do not have to....if there is no stop line then you must stop even with the stop sign....which is still before the corner. The other argument is that there was no traffic on the thru street to endanger but that is weak......if you would like to retian a lawyer to help , call me at 732-286-2170....I am located in Toms River.

There many illegal stop signs in the state of New Jersey. No offense occurs when one drives through an illegal stop sign.
