Legal Question in Traffic Law in New Jersey

Ticket issued on Private Property

I was pulling out of my developement and was about 20 feet from the curb when I saw a police car crossing the street.I waited for him to pass before I pulled out and he stopped looked at my car and pulled in.I remained at a stop shut off my car and was told I had an expired inspection sticker, was on the suspended list and had an expired registration.I told him I was aware and was caring for a disabled person and was suspended over an unpaid Garden State Parkway toll issued by the town not the Parkway. That was sent to me in the mail .He allowed me to park my car in my garage and issued a ticket for no reg,and driving suspended. The ticket location was filled in as the street I was no pulled on to,my wheels never hit that street. Can he write that on the ticket if it happened on Private Property?

Re: Ticket issued on Private Property

I believe that there is a diffence between property owned by you and an apartment comlex where you are a tenant. Perhaps, if you were driving on your farm you would not have a problem but you were driving on property used by others. with the apparent intention of entering the street. N.J.S. 39:3-40 makes no reference to where operation of a motor vehicle is prohibited once one's driving license is suspended; it merely prohibits such operation of a motor vehicle.

You may be able to avoid the further suspendsion of your driving privileges but there is a clear

violation

Re: Ticket issued on Private Property

Seems like you wanna go this one alone and you are looking for a way out. I suggest you at least meet face to face with a lawyer as you are facing some serious charges there in you could get jail time depending on how many times you've been convicted for DWS and you could get your license suspended for more time.

My consultations are always free. Call my office at 732/247/3340 and we'll see what we could do about your case.
