Legal Question in Traffic Law in New Jersey
Traffiic Accident with Criminal case
I had an accident on 9/10/05. The other driver with emotoinal madness while chasing me in parallel lane and signalling me to stop for a fight, hit my rare right next to taillight while I was merging into his lane. It was not major damage, but he chased me and stopped my car and started punching and kicking on my driver door trying to hit me when I stopped. I called 911 and the police came over filed a criminal case against him. Then he filed a reckless driver complaint and few days later again aggravated assault complaint on me trying to take advantage of legal scenarios. He filed these baseless allegations to get away from criminal case against him.
What are my options in this scenario? What is the best solution for me?

You have a nasty situation. It is not possible to solve your problem by this bulletin board, you need an attorney in court to protect you.
Re: Traffiic Accident with Criminal case
I would have to see the police report on this incident, but based on what you are saying the charges he filed against you can probably be beaten at trial. Since he filed them against you and the police didn't they are called Citizen's Complaints and he has to try and prove to the court on his own that you did what he is (falsely) accusing you of. Since these are serious charges, I would advise you to hire a lawyer to help defend you against them. You will have to appear in court on them when they are listed. I am an attorney who has handled many cases similar to yours in various courts in New Jersey in the past. I would like to discuss your case with you in more detail. Please call me at 908-272-0111 to discuss your case. There is never any charge for simply talking to me about a case. Thank you.

You should hire an experienced criminal attorney immediately to deal with the prosecutor and attempt to steer clear of a formal charge called an indictment.
