Legal Question in Traffic Law in New Jersey

my wife hit another truck while parking in a private buissness parking lot .she recieved a 39:4 97 careless driving citation ,what can we do about this citation ?can it be fought because of it happening in a private parking lot?

Careless Driving involving an accident - I suggest you hire a lawyer. In general though, just because it happened in a private parking lot does not preculde prosecution on this ticket. Careless driving carries 2 motor vehilce points and a moving violation where you were involved in an accident can make the situation a little more difficult. I have several questions. Was the ticket issued by a police officer and was the officer present at the time of the accident? There must have been a police report and I agree with the other lawyer that I would need to see it to give you a better idea of how to proceed. Was anyone injured, or did the accident only involve property damage. Who was present at the time of the incident. There are many questions that need to be addressed. You should fight it. Just because there was a parking lot accident does not by itself mean she was driving 'careless' under the statute.
