contesting beneficiary

what happens if ins co goes to outside council because im contesting and beneficairy(friend) of life ins has not been able to be located would the judge rule in my favor(im only relative and the original bene before it was changed) or does the beneficairy need to be present?there is no will and is there a statue of limitations for filing its almost a year now since the death
