Inheritance issue/mother lives in NJ

My husband's sister has terminal liver cancer and may not survive the year. She is not married/no children but does have a live-in boyfriend. Husband's mother is alive (92 yr) but ailing. Mother has left 50/50 to son and daughter. What is mother passes just before his sister? We don't know if sister has a will or has left her estate in a Will to her boyfriend. Is there a way to protect mother's money by putting it in a trust for her daughter and giving her $13K/year instead of everything at once, for instance as long as daughter is alive? This way mother's money will not go to boyfriend if sister has a Will saying so. Thank you.
