Legal Question in Wills and Trusts in New Jersey

When an unmarried person dies intestate in NJ and has two living siblings along with three nephews of his deceased siblings are the nephews also considered legal heirs to the estate?

Yes, if they are the only closest living relatives. This presumes there are no spouse, children or parents surviving. Next is siblings and children of deceased siblings, the latter inheriting the share their parent would have in herited is he/she survived. FYI, since the potential heirs are not Class "A" heirs, there may be inheritance/estate taxes associated with the estate. You should consult an estate attorney for assistance.
