Legal Question in Workers Comp in New Jersey

Changing Jobs

I injured myself at work back in Feb. I am receiving workers comp. benefits now. My question is, i have been offered another job, would i be able to quit my present job. And if so, would i have to payback Workers comp? What is the general rule? I heard i would have to wait 2 weeks to take another job after i was cleared to work.

Generally there is no issues if you desire to change jobs, however it may effect your temp benefits if you are receiving any or are entitled to receive them to the extent you can or cannot work.

In New Jersey, any employee, (even if you are a construction worker, secretary or injured in a car accident while working), injured at work, regardless of fault, may be entitled to three benefits:

1. Free medical care;2. Pay while unable to work; and 3. A cash settlement for loss of function caused by the work-related injury. In order to protect these rights a claim petitioner must be filed for you - my office can assist in this matter.

You would not have to pay workers comp back anything. You would also be able to still treat (if you still need treatment)but you most likely would not be able to collect your pay if you are unable to start your new job because of your injury.
