Legal Question in Workers Comp in New Jersey

Compensation amount in NJ

I received a crush injury to my right hand on 11-21-06 and have not worked since. No broken bones just extensive soft tissue damage, a surgical trigger finger release of my thumb and 2 months of physical therapy and arthritis for the rest of my life. The accident was not my fault. It was undermaintained equipment that the employer knew was malfunctioning. I work as a mechanic and am right handed. How much can I expect to get from workers comp for a final pay out for permanant injury? I am not planing on filling a seperate suit against the employer at this time. I will be able to return to work close to 100% moveablity but the pain and numbness the workers comp Dr. is unsure of. I did receive the max per week from NJ worker's comp insurance and they paid all medical bills thus far. I am just concerned after I go back to work and if I will see anything for all the pain and BS from the past 5 months.

it is very difficult to answer this question without the benefit of a medical exam which wouled fix your degree of permanency and the part of your body in play. Please do yourself a favor and get an attny. You need an experienced lawyer to deal with the permanency issue

Worker's comp has three type of benefits; medical, temporary and permanancy benefits. Your employer should cover all medical and pay you temporary until your doctor discharges you from treatment or says you are ready to return to work. Permanancy is based upon a combination of your wage rate and the level of permanent injury that you suffered. Usually the employer through their carier will admit to a small amount, but it is advised to have an attorney in order to maximize the recovery. It is hard to say how much you would recover without knowing your wage rate or having an exam; but it is based upon the percentage of disability or the hand and arm in this case.

You may also have a case against the employer or the manufacturer of the machine which would allow a much greater recovery. The best wat ot make this determination is to speak to an attorney who specializes in these areas.
