You can file in either state, but since you live in New Jersey it would be better to file in New Jersey because there are workers compensation courts in every county, so you will end up going to court closer to home than if you file in New York. I am an attorney who has handled hundreds of workers compensaiton claims in various workers compensation courts throughout New Jersey in the past.
