Legal Question in Workers Comp in New Jersey

Hurt at work by faulty equipment.....

I was injured at work by an adjustable press. A cable broke on it that was ''fixed'' previously by my employer and it crushed my right hand. ER and workers comp. ortho. surgeon stated it is a severe contusion. Three weeks later and I can still not move my thumb and it has swelling and pain in my palm. I visited a hand surgeon out of my own pocket and he said something is definatly wrong and I need a MRI to see what is wrong. I am receiveing worker's comp. at its max for NJ. But I have a part time job that I can not work at either. I am loosing money in wages at both jobs and do not have the money to pay for a MRI. I do not trust the workers comp. DR and the workers comp. insurance will not send me for a second opinion. I contacted a lawyer and they said they can nothing for me until something is done for my hand. I don't think that is correct....Can someone please explain if a lawyer could help me at this point and also after my hand is fixed is there anything I can do. Thank You.

if you are collecting max benefits, there is not much that can be done. However, if you are not happy with your doctors, an attny can attempt to remedyu that. In addition, you may have a products liability case against the manufacturere of the machine. Call me and I can discuss your optins and refer you to a competent attny in your area.

You will have a lot of worker's compensation attorneys responding, because you have a fairly large case worth a fair amount of money. A crushed hand is a serious injury.

Find an attorney who does a great deal of worker's compensation (I do NOT and can not help you, except that I have several friends who do this work, and they are quite smart guys). Get a lawyer immediately.

You have a legitimate workers compensation claim and you should have a lawyer representing you to at least try and get the MRI and second opinion paid for by workers compensaton. You do not need to have your hand healed before a lawyer can get involved. I appreciate your frustration with the situation. There are things that can be done. Worker's Comp has to pay for needed medical treatment and it appears that your insurance carrier is not doing what they are supposed to. While there are no guarantees, this is a siutation where an attoreny can help you get those benefits.

There is nothing to do about the lost wages if you are at max, but there are two other issues that can be addressed by an attoreny, medical and permanency benefits.
