Recurring Injury
An employee hurts his back while at work in September, he is placed on workmens' comp and is prescribed physical therapy. His condition gets better and he returns to work. He continues to have tightness & other problems with his back, does not report it to Employee Health Services until about 2 weeks ago. He has been out two days last week due to back problems, returns to work and is out again this week due to more back problems. Can his condition fall under workmen's compensation? Thank you

As long as the accident was reported in a timely manner (as it was here) and is acknowledged as being compensable by the company's workers compensation carrier (as it was here also), and the current problems are for the same body part as the original injury, then this recurrance can fall under workers compensation. He does need to report it to the insurance carrier if he wants to get more physical therapy or other treatment. Due to the nature of the injury he may also be eligible to receive a permanent disability award, money for having a serious and recurring work related injury.
