Legal Question in Workers Comp in New Jersey

Work related injury

I work as a vendor inside another company's store. I was injured at the job, when a customer knocked something over. As the object started to fall out of instinct I reached out to catch it. It was to heavy for me and it bent my wrist back. I sprained my wrist, my company sent me to one of their doctors and the doctor has put me on light duty. Since I work in another company's store they do not have light duty, so I am unable to work. My company has been accomodating me with workmens comp, but you know you don't get your whole check which can hurt a person. Anyway my question is the other company's employees were supposed to put this item up on the shelf and they left it leaning up against the shelf since the night before. Am I entitled to any other compensation? Because if I was a customer and got hurt I know they would most likely be entitled to something. I have not returned to work yet and it has been a month. My wrist started feeling better with the therapy, until they started having me lift light weights in order, so I could stenghthen it before I returned to work. When I started lifting the weights my wrist then started to be painful again. Please if you have any advice this would sure help. Thank you!

Re: Work related injury

You may have a claim against the other company, however, workers comp is entitled to 2/3 of the money they paid to you back if you recover from the other comapny. If your injury is significant enough, it may be worth pursuing.

Re: Work related injury

In New Jersey, any employee, (even if you are a construction worker, secretary or injured in a car accident while working), injured at work, regardless of fault, may be entitled to three benefits:1. Free medical care; 2. Pay while unable to work; and 3. A cash settlement for loss of function caused by the work-related injury.

A Claim petition must be filed on your behalf which I can provide assisstance. No fee until you recovery an award.

You may be able to recover additional benefits against the store if you can prove that the store was negligent.
