Legal Question in Business Law in New York

complaint

A complant was filed against my NY based corporation. I answerd the complaint as President (which I am). The Plaintiffs attorney set the answer back, stating the answer must come from consel. I can not represent my corporation?

That is correct. An attorney must represent a corporation in a litigation. While you are permitted to represent yourself, if you had been sued individually, a corporation is deemed to be a "person" separate and distinct from the individual who may be its sole owner. Thus, you need a lawyer

That's correct. A corporation must appear in New York's court system through a licensed attorney.

Unfortunately a corporation cannot be represented by an officer. Counsel is required in NY.

As other responses stated, a corporation must be represented by counsel. However, you do NOT need an attorney if the suit is in small claims court (up to $5,000.00). If it's for up to $5000 in alleged damages, try to get the case knocked-down to small claims court.
