Legal Question in Personal Injury in New York
being sued - Fraud
State- NY I had a littile fender bender about year and half ago. I hit the guy from behind because he stopped short and I got distracted by sunlight No one was injured and police officer came and filed a report and let both of us go. I reported to my insurance company and that was it. Now year and half later I received a letter stating that he is suing me for 2 million. I know it it pure case of fraud. The sue states that he is unable to work, was severely injured, brusied and wounded, suffered, still suffers and will continue to suffer for some time. Became sick sore, lame and disabled and will remain form considerable amount of time. Can he actually win this and what you do to protect myself and my assests?

First thing- contact your insurance company. They will defend you for an amount up to the policy limits -ask them what those limits are. If there is a gap between your policy limits and the two million dollars being sued for, you should consult an attorney to protect your assets for the difference.
