Legal Question in Bankruptcy in New York
Can I file personal bankruptcy, and not include my home or car, which I am still making payments on and have a mortgage?

You can file a chapter 13 and set up a payment plan for your home with your mortgage company.
You can also reaffirm your debt for you car. You, however, cannot exclude these debts.
