Legal Question in Business Law in New York
Failure of payment without a contract
Firstly I realize it's stupid to not have a contract,
that said let me explain the situation. A friends
mother asked if I would design a multi-media
presentation for her mother for $2,000 in three
days. I did it and went to a meeting in Penn. to
present it for her. After the meeting I invoiced her
and gave her a month to pay...no check. I have
spoken with her frequently and she has left her
old company and is working elsewhere and
claims her old company is the one who has to pay
me. Her old company claims to not have the
money and is saying that possibily next week I
may recieve $500 of the $2000 that is owed. This
is all after the fact that I have been told on two
occasions that I should be recieving a check in ''5
days''. Long story short she is in California I am in
NYC I want to hold her financially responsible for
payment...can I do so with a verbal statement by
her daughter asking if I would do the job for $2000
and me saying yes?

Your work has a value...and a benefit was derived by it...the issues is for whom the benefit inured to...was it the woman or the company? If the company is here in NYC small claims in almost county is fine if it is a business doing business in NYC

Re: Failure of payment without a contract
Tough case, if your friend's mother denies the arrangement. She probably won't.
This is just what small claims court is all about.
Give it a shot.
