Legal Question in Business Law in New York

I am a professional skateboarder for a company. They use my name on their skateboards for which I am compensated. However I have no contract with them.

Recently I came across a minature version of one of my pro model skateboards made by a company called tech deck. I was never informed that my this was done. And I was never compensated. I spoke to the owner and verified that he was paid from tech deck but he wont give me a straight answer about the portion of of money that i should have received from the amount tech deck paid him.

What would be the legal ramifications of this if i took the matter to court.

The issues would be:

1. What rights did you have to the design that they used without your consent?

2. Whether they used your name or image without your consent (as opposed to the design itself), and what they did with it.

3. What your verbal contract actually means, and whether it is enforceable.

As an aside, an endorsement contract of this type that is not in writing is highly unusual, and is highly unlikely to be to your advantage.
