Legal Question in Business Law in New York
Safety Training liability
I have certification from O.S.H.A. to conduct safety training. I, along with a partner, have our own business, but do not carry any insurance. I am about to train on the Safe operation of Powered ForkLift vehicles. Will I be liable if an individual gets hurt after I have trained them? I have a partner, who is also afraid that he could be liable. Would the individual who sues be able to go after my/our personal assets?

Re: Safety Training liability
I would strongly suggest that you obtain liability coverage for your business. Whether or not you might ultimately be found liable should someone get injured and sue, you might nevertheless be involved in defending a lawsuit which could be extremely costly. If you had insurance coverage, the cost of defending such a suit would be borne by the insurance company.
Re: Safety Training liability
To be safe (no pun intended)whay not start an LLC or Sub C corp? This is its own legal entity and in any suit it should be sued, not you personally.
An attorney can start for but speak to your accountant about the form of structure it should take.
Good Luck

Re: Safety Training liability
Personal liability on your part in case of a lawsuit is completely fependant on what business structure you have your business organized as, whether it is a partnership, a corporation etc.?
