Legal Question in Business Law in New York
I am looking to sue a competitive small business for moneys I paid but never received services. My question is, there is an owner who moved out of state and a "financial backer"as she calls herself. Everyone knew she was a partner. ....is a financial backer a partner? Can I sue both of them? In addition, since the main owner has moved out of state the "financial backer" has beent rying to restart the business and change the name.

What type of business is it? This will have an influence on the answer.
A financial backer is not necessary a partner, unless there is a partnership. If you determine it is a partnership versus a corporation, LLC, or other entity, you have to see if the financial backer was in fact a partner. Usually, the agreement between the individual and financial backer will determine this issue.
