Denial of a Habeas in the 3rd Judicial

This is my third attempt pro se to get myself before the judge. I have sent myriad motions and affidavits. I am at Elmira and have been for 13 years. Four years ago I learned my case was never processed through the local criminal court with the proper accusatory instrument and therefore the conviction was never legal. I want to bring this out on habeas. There was no conviction so I should be given my liberty. Do you think I could go to the Court of Appeals In NY and higher. I spend all my time in research.

Have you filed a habeus petition in Federal District Court? That is the most advantageous Court to assert that your constitutional rights have been violated.
