real property
want to build or sell land next to our property but smithtown deemed it not single and separate but i own it and deed is in my name. they refuse permission

From your question, it appears that the property you wish to sell is part of the property o which you want to keep. Therefore, you would need to go though the process of having you lad surveyed and then seek to have the land that you want to sell severed from the property you want to keep.
