Legal Question in Construction Law in New York
Contractor's LLC Now Inactive
I asked a question yesterday regarding suing my contractor for a poor job and was assured that the statute of limitations has not run out (thank you for your replies). However, I checked the status of the LLC and it is now inactive. Can I still go after him?

Re: Contractor's LLC Now Inactive
The deactivation does not necessarily mean you can't go after the contractor. Heck, any business can advise the Department of State that they are inactive.
The major stumbling block is in collecting. The construction industry has been hit harder than most due to the virtually non-existent demand for new construction. Many contractors are simply closing shop or have no assets.
Wish my response could be more optimistic!
