Legal Question in Consumer Law in New York

retail sales, customer complaint

i work for a large furniture retailer in NYC. We sold a sofa to a customer who had it delivered to her forwarder, then shipped to Greece. When it arrive, it was the wrong style. do we have any obligation to correct the problem? now that the merchandise is in Greece, it presents a challenge. She did not see the peice before having it shipped. we are at fault for sending the wrong style but where does our obligation end and her responsibility begin to check it before she ships it across the Atlantic?

Re: retail sales, customer complaint

This situation can be tricky. I think the purchaser had an obligation to inspect the goods upon receipt and before shipment, but if you knew the circumstances re: the overseas forwarding of the piece, it may not bode well for you in court. If the customer files a grievance with their credit card company, it's up to the discretion of the bank to reverse the charge or not.
