Legal Question in Credit and Debt Law in New York

My wifes employer received a subpoena from Foster & Garbus a collections agency.We have no recolection or statements or any knowledge of an unsettled debt. This happened once before because she neglected to pay her bills and our accounts were frozen also by Foster & Garbus. I paid the debt and got a letter of settlement. Can they with hold her wages?

If they have a subpoena, there must be an open court case. It's very important that your wife finds out what is going on in her case. Indeed, has she been served with a complaint regarding this open case? If so, has she provided an answer, which includes the fact that you paid the debt?

If this case relates to the debt you paid off, simply contact the attorney to inform him that the debt has been settled. Also state that if the matter is not dismissed, you will hire an attorney and seek sanctions and court fees regarding the company's frivolous litigation.
