18 in car with beer no consumption

My son is 18 (Oct, 1990) and decided to go to a club with 2 other boys. He was a passenger. In the car was unopened beer. My son did not consume any, just looking for a ride to and from the club. It is a non alcohol club. They were pulled over for a problem with the headlights and my son received a court appearance summons. What is the advised position for him when he appears in court.
