Legal Question in Criminal Law in New York

140.05

I was on the roof of a friends apartment watching a movie. One of the tenants heard us moving around up there, and called the cops. We had beer, but we are all over 21. There were no drugs or paraphernalia. We were very respectful toward the cops and they to us. They were very understanding. They gave us summons to appear in court for a violation of 140.05. They did not include the beer in their write ups. As I had been invited by paying tenants of the building, and there were no posted signs, I was not aware that I was trespassing. My question is, should I fight this, will it be worth it, and do I need a lawyer?
