Legal Question in Criminal Law in New York
I got an ACD but i have a question regarding that. I am taking my lic. boards for an RN and if they as me to fill a form out and the form asks have you every been convicted or being convicted how to do i answer the question

An ACD is not a conviction. If the question is: have you ever been convicted of a crime - the answer is NO. If the question is: have you ever been arrested - the answer is YES.

you have not been convicted and the way the ACD law reads, that after the dismissal you are placed in the position you were before you were arrested, it means that you were never arrested in contemplation of law.
